Terms of Service

By accessing this website or purchasing any DigitalHubZ service, you agree to these Terms of Service. If you do not agree, please do not use our services.

1. Services

DigitalHubZ provides web hosting, domain registration, website development, digital marketing, AI automation and related digital services (“Services”) as described on our website and in individual service agreements.

Specific terms for individual services (e.g. hosting SLA, project scope) are set out in separate service agreements or order confirmations, which take precedence over these general terms where they conflict.

2. Account registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@digitalhubz.com if you suspect unauthorised access.

3. Payments & billing

Services are billed as described at the point of purchase. Monthly subscriptions renew automatically unless cancelled before the renewal date. Annual plans are non-refundable after 30 days from purchase. Project-based work is invoiced per the agreed payment schedule.

Late payments may result in service suspension. We reserve the right to charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

4. Acceptable use

You agree not to use our services to:

  • Host or distribute illegal content, malware or spam
  • Engage in phishing, fraud or deceptive practices
  • Violate the intellectual property rights of others
  • Conduct DDoS attacks or attempt unauthorised access to systems
  • Send unsolicited bulk email (spam)
  • Store or transmit material that is defamatory, obscene or harassing

Violation of this policy may result in immediate service suspension without refund.

5. Intellectual property

On full payment for a project, you receive ownership of the bespoke code and design created for you. We retain ownership of any pre-existing tools, libraries, frameworks or code we use to deliver the work, subject to the licences under which they are provided.

We may list completed projects in our portfolio unless you request otherwise in writing before project commencement.

6. Uptime and service levels

Hosting services are provided with a 99.9% monthly uptime target. Scheduled maintenance, force majeure events and third-party failures are excluded from uptime calculations. Where we fail to meet the SLA, we will apply service credits as described in the applicable hosting plan.

7. Limitation of liability

To the fullest extent permitted by law, our liability is limited to the amount paid for the service in the 3 months preceding the claim. We are not liable for indirect, consequential, incidental or special damages including loss of revenue, loss of data or loss of profits.

Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

8. Termination

Either party may terminate a monthly rolling service with 30 days' notice. We may terminate immediately for material breach of these terms, including acceptable use violations. On termination, your data is available for export for 30 days before being deleted.

9. Governing law

These terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We may update these terms. Material changes will be notified by email at least 30 days in advance. Continued use of the service after the effective date constitutes acceptance of the revised terms.
